Ao contrário do que ocorreu na energia elétrica, cuja competência ficou exclusiva da União, a competência da matéria gás foi dividida entre os Estados e a União.Os Estados ficaram com a responsabilidade de estabelecer regras para explorar diretamente, ou mediante concessão, os serviços locais de distribuição de gás canalizado e a União com a atividade de comercialização (compra e venda) de gás natural.Em 2009, foi sancionada a Lei do Gás usual (Lei Federal nº 11.909/2009), que incumbiu a União a competência para legislar e fiscalizar as atividades relativas à comercialização de gás usual no território nacional.Em 2015, os Estados continuam atuando na comercialização do gás average como se estivessem no período antecedente à Constituição Federal/ 1988, editando normas, fiscalizando, etc., invadindo, assim, a esfera de competência federal.Com este livro, procuro desmistificar alguns pré-conceitos jurídicos e regulatórios relacionados ao mercado do gás normal, sobretudo esclarecendo a diferença conceitual existente entre os regimes jurídicos do gás usual e do serviço de distribuição do gás canalizado.
